Beginning July 1, 2025, Wyoming prescribers can prescribe FDA-approved prescription drugs for conditions outside the drug’s FDA-approved uses. Covered prescribers are licensed physicians, physician assistants, dentists, optometrists, and advanced practice registered nurses. Prescribers and pharmacists must stay within their allowed practice, and pharmacists need a valid prescription to dispense these drugs. Licensing boards cannot revoke, suspend, limit, deny, or otherwise discipline a license solely for covered off-label prescribing or dispensing. The law excludes Schedule I or II controlled substances under federal or Wyoming law and prescriptions intended to induce abortion. It also excludes prescriptions intended to transition a minor’s biological sex or affirm a perceived sex inconsistent with biological sex. Wyoming’s medicine, dental, optometry, nursing, and pharmacy boards must adopt rules to carry out the law.
Beginning July 1, 2025, Wyoming protects certain treatment-related conduct from being classified as unprofessional conduct. This covers a prescriber’s or pharmacist’s recommendation, prescription, use, or opinion about a medical treatment. The treatment must be unregulated by health licensing boards, the Wyoming Department of Health, professional associations, and the FDA.
