Permanent, no-fee easements for existing roads

The law grants a permanent easement over state and school lands for any county or city road in place before January 1, 2025. No fee, charge, or assessment may be billed to counties, cities, or road users for these easements. This secures public access on those roads.

New roads after 2025 need permits

For county or city roads built on or after January 1, 2025, there is no automatic easement over state or school land. Local governments must follow existing laws and Board rules to secure rights-of-way.

Deadlines to document and record easements

By August 1, 2025, the state director must list all county and city roads on state or school lands, and the Board pays documentation costs. By October 31, 2025, the Board must set rules and the director must notify all counties, cities, and towns which roads got easements. By April 1, 2030, local governments must submit complete records. Within 90 days after the Board receives the records, it must record the easement with the county clerk.
