Existing public roads get free crossing rights
The law takes effect immediately and grants permanent rights to cross Wyoming state and school lands for qualifying public roads. Roads must have been established before January 1, 2025. County roads qualify through county-road law or a county resolution assigning responsibility for improvements and maintenance. City and town roads qualify when the municipality established them and is responsible for improvements and maintenance. Local governments and road users pay no fees, assessments, or other costs for the easement.
Newer public roads need separate crossing approval
County, city, and town roads built or established on or after January 1, 2025, receive no automatic easement. For these roads across state or school lands, local governments must secure crossing rights under state law and land board rules.
Local governments must document road crossing rights
By August 1, 2025, the state land director must give the land board a road list and needed easement documents. The board pays the costs of that documentation. By October 31, 2025, the board must issue needed rules, and the director must send local governments the covered-road list. Counties, cities, and towns with covered roads must submit complete records to the director and board by April 1, 2030. Within 90 days of receiving all needed records, the board must provide proof of the easement and record or file the documents with the county clerk.
