Bill Overview

Analyzed Economic Effects

5 provisions identified: 1 benefits, 3 costs, 1 mixed.

Commercial drivers face fraud retesting deadlines

Beginning July 1, 2025, credible information of suspected licensing fraud triggers a retesting process for commercial license or permit holders. After written notice, holders have 30 days to contact the Wyoming Department of Transportation and schedule required retesting. Failure to contact the department, take a required test, or pass a rescheduled test leads to license cancellation. It also bars commercial driving for one year.

More violations threaten commercial drivers’ licenses

Beginning July 1, 2025, Wyoming adds serious traffic violations that can bar drivers from commercial driving. These include improper or erratic lane changes and driving without the required commercial license, learner’s permit, class, or endorsements. Texting and handheld-device use prohibited by state or local law also count. Drivers cited only for not carrying their license or permit can avoid that violation by proving it was valid on the citation date, at or before a hearing. Substantially similar violations in other jurisdictions also count.

Young commercial drivers face stricter alcohol limits

Beginning July 1, 2025, drivers under 21 face at least one year of commercial-driving disqualification after a first qualifying alcohol violation. They must have held a valid commercial driver’s license or commercial learner’s permit when the offense happened. The threshold is an alcohol concentration of 0.02% or more. It applies while driving or being in actual physical control of a motor vehicle, not just a commercial vehicle.

Erased youth records still affect commercial driving

Beginning July 1, 2025, Wyoming can use expunged minor license-suspension records when deciding commercial-driving disqualification. Covered suspensions under the under-21 possession or consumption rules are expunged 12 months after conviction, excluding violations of W.S. 31-5-233. For ordinary inquiries, the suspension is treated as never having happened. The records are not public, but law enforcement retains access. Insurers cannot use these records to automatically raise premiums or cancel coverage for the minor or their parents.

Commercial license applicants can receive testing waivers

Effective upon enactment, Wyoming’s transportation department has authority to waive commercial-license knowledge tests, skills tests, or both. Applicants must meet requirements set in department rules. Those rules must include at least the requirements in U.S. Department of Transportation regulations. The law directs the department to adopt implementation rules, and waivers are not guaranteed to every applicant.
