More bond options for Wyoming operators

Beginning July 1, 2025, covered Wyoming operators have clarified options for deposits replacing bonds with the Department of Environmental Quality. These include cash, government securities, federally insured certificates of deposit payable to the department, irrevocable letters of credit, or combinations. Noncoal mines and solid waste facilities can get letters of credit from banks or credit unions. For noncoal mines, this applies only on land not owned or operated by the federal government. Coal mines must use banks for letters of credit. Issuers must be organized to do business in the United States and insured by FDIC or NCUA, as applicable. The new rules apply to letters issued on or after July 1, 2025. The Environmental Quality Council must adopt implementing rules on the department’s recommendation; that duty took effect when the act became law.
