Only Wyoming-licensed doctors with hospital admitting privileges within 10 miles may perform surgical abortions at these facilities. Doctors performing at least one must report each surgical abortion and attest that they are licensed and in good standing. They must document hospital privileges in the form and frequency the health department requires. Breaking the physician-license requirement is a felony carrying 1 to 14 years in prison. Violating the hospital-privileges requirement carries a $1,000 misdemeanor fine per surgical abortion; non-physicians also face a $1,000 misdemeanor fine per abortion.
Wyoming surgical abortion facilities outside hospitals must each get a separate, nontransferable outpatient surgery-center license before performing surgical abortions. The health department must adopt rules at least as strict as surgery-center rules and physically inspect facilities at least every three years. Licensing violations are misdemeanors carrying fines up to $1,000 per offense, with each calendar day counting separately. The abortion definition excludes care to preserve an unborn baby's life or health, removal of a dead unborn baby, and ectopic pregnancy treatment. It also excludes treatment of cancer or another condition that may be fatal or harmful to the unborn baby. The law took effect immediately upon enactment and creates no individual right to abortion. It does not recognize abortion as lawful or as a health-care decision under Wyoming's Constitution. The Life is a Human Right Act and Wyoming statute 35-6-139 control when this law conflicts with them.
