Bill Overview

Analyzed Economic Effects

3 provisions identified: 2 benefits, 0 costs, 1 mixed.

Families can recover damages from websites

Beginning July 1, 2025, parents or guardians can sue covered websites on behalf of minors harmed by age-check violations. Successful claims receive $5,000 for each separate age-check failure, plus other damages, court costs, and reasonable lawyer fees. Anyone can sue a covered website that knowingly keeps identifying information after granting access. Successful privacy claims receive damages, court costs, and reasonable lawyer fees; the $5,000 award applies only to age-check claims. These civil lawsuits are the only way to enforce this law, and its Wyoming limits and provider exclusions apply. Giving up the right to sue, or blocking it based on someone's past conduct, is generally invalid. Constitutional protections for contracts limit that rule. Agreements made in violation of the law are unenforceable, but the act does not alter contracts or obligations made before July 1, 2025. Other legal duties and remedies remain unchanged.

Website users gain age-check privacy protections

Beginning July 1, 2025, covered websites cannot keep a person's identifying information after granting access to the material. Third-party providers performing the required age checks must follow the same rule. The protection applies within the law's Wyoming scope and provider exclusions, subject to federal law and constitutional limits.

Age checks protect kids, limit access

Beginning July 1, 2025, covered profit-making websites must check everyone's age before allowing access to obscene images or child pornography. They must block covered minors under 18. Covered minors are Wyoming permanent residents, those who lived there over one year, or those present for 31 consecutive days. Accepted checks include government IDs, credit or debit cards limited to adult cardowners, or other reliable methods. Government IDs include Wyoming or out-of-state licenses or IDs, U.S. passports, military IDs, and tribal IDs. Internet providers and their affiliates or subsidiaries, general search engines, and cloud services are excluded. Federal liability protections remain, and the law must follow the U.S. Constitution, including limits on regulating interstate commerce.
