Effective July 1, 2025, the law extends Wyoming school districts’ higher reserve threshold from June 30, 2026, through June 30, 2028. The 30% threshold, rather than the usual 15%, applies to fiscal years ending June 30, 2022, through June 30, 2028. It is based on each district’s prior-year foundation program funding amount. Districts must separately track and report reserves between 15% and 30%. They cannot transfer or spend that portion for capital construction. By January 31 each fiscal year, the Department of Education must calculate each district’s excess reserves. Subject to existing exceptions, reserves above 30% count as state revenue for school funding distributions and tax rebates. Money committed to existing legal obligations or legally restricted programs does not count toward reserves. Separate major building repair and replacement accounts are also excluded; those repairs do not count as capital construction. Reserves from the fiscal year ending June 30, 1997, remain separately tracked and excluded until spent. Certain protested-tax settlement revenues are excluded for no more than one year after the receipt year, with written district verification and county treasurer certification. The department must issue rules covering district reporting and procedures. This law does not directly provide household payments.
