Beginning July 1, 2025, Wyoming offers carbon dioxide providers a base payment of $10 per ton. Providers must capture the gas in Wyoming, supply it for Wyoming oil or gas recovery, and store it through that production. The capture technology and gas must meet federal 45Q tax-credit rules as of January 1, 2023. Providers must receive that federal credit first, keep qualifying, and apply through the Wyoming Energy Authority. The state payment changes in proportion to changes in the gap between federal credits for recovery and separate underground storage. No state payment is available when the separate-storage credit is equal to, below, or no more than $15 above the recovery credit. Payments are reduced proportionally when account funds cannot cover all eligible claims. The Authority administers applications and rules and can consult other agencies to check federal-credit compliance.
Beginning July 1, 2025, the law transfers $10 million from Wyoming's Legislative Stabilization Reserve to a new oil recovery stimulus account. This money supports provider payments rather than household relief and is unavailable for other state uses. Account funds are continuously available to the Governor only for authorized stimulus payments, with the State Auditor making payments. The State Treasurer invests the money, and earnings stay in the account. By August 1 each year, the Department of Revenue reports specified severance taxes from production supported by the stimulus. The report includes all qualifying taxes under W.S. 39-14-204(a)(iv) and half under (a)(iii); the Energy Authority also reports stimulus amounts. By September 1, the Auditor transfers an amount based on those taxes from the General Fund, adjusted for stimulus changes. Transfers first refill the stimulus account to $10 million, then send any remainder to the reserve. These annual transfers stop once the reserve has received a total of $10 million under this law. If no account money has been spent before July 1, 2034, all remaining funds return to the reserve. By November 1 annually, the Energy Authority reports payments and related revenue impacts to legislative interim committees.
