Beginning July 1, 2025, the Board of Land Commissioners must issue rules to run the sage-grouse credit system. The rules must include criteria that allow operator-offered mitigation and operator-offered restoration credits. The criteria must follow the same-area and operator-responsibility rules. The rules also cover measures that reduce or avoid impacts.
Beginning July 1, 2025, no one can use eminent domain to take land for sage-grouse mitigation projects. Property owners are protected from condemnation for these mitigation activities.
Beginning July 1, 2025, operators can do sage-grouse mitigation in the same or a similar Wyoming area and earn credits from the Board. They can do this instead of, or in addition to, buying credits from others. Operators must stay responsible for the mitigation for the full time the impact lasts. They can delegate only to a Board-approved mitigation credit provider.
