Landowners protected from habitat mitigation takings
Beginning July 1, 2025, no one can use eminent domain for the habitat mitigation activities covered by this law. This bars forced property takings for those activities, not for every public purpose.
More habitat options, but operators stay responsible
Beginning July 1, 2025, operators can do greater sage-grouse habitat mitigation instead of, or alongside, Wyoming’s mitigation credit system. They can receive credit from the Board of Land Commissioners for this work. The service area must include the affected Wyoming lands or reasonably equivalent lands elsewhere in Wyoming. Operators remain responsible throughout the expected impact period; only a board-approved mitigation credit provider can take over that responsibility. The board must adopt rules covering operator-offered measures, restoration credits, and measures that reduce or eliminate take of sage grouse. These rules must address ecological functions, services, and values, with consultation from state agriculture, environmental, wildlife, oil and gas, transportation, and wildlife trust agencies.
