Beginning July 1, 2025, Wyoming’s Secretary of State has new grounds to cancel trademark, service mark, and trade name registrations. Cancellation must serve the public interest. The applicant or registrant must have provided fraudulent information or failed to correct false information in a filing after being asked. The Secretary must send written notice explaining the grounds by certified mail, giving the registrant 60 days to respond. The Secretary must cancel if no response arrives or the response fails to reasonably show that each cancellation ground is absent. The Secretary must then send a cancellation notice by certified mail. Registrants can appeal to chancery court or a district court with authority over the case within 30 days after that notice is sent. They must ask to set aside the cancellation and attach copies of all documents filed with the Secretary. The court can order reinstatement or other appropriate action, and its final decision can be appealed.
