Beginning January 1, 2026, Wyoming clarifies and limits its pollution-control property tax exemption. It covers facilities, installations, machinery, and equipment designed, installed, and used mainly to prevent, control, or eliminate pollution. Property can qualify whether attached to land or not. For property with other useful purposes, only the assessed value needed for and devoted to pollution control is exempt. Facility portions with value as a specific source of byproducts that can be sold are excluded. Facilities built solely to capture nonpoint source carbon dioxide are also excluded. The Department of Revenue determines exempt portions for state-assessed property; county assessors do so for county-assessed property. The law immediately requires the department to issue implementing rules, while the exemption changes take effect January 1, 2026.
