3 provisions identified: 1 benefits, 1 costs, 1 mixed.
Wyoming public schools serving pre-kindergarten through grade 12 must label shared restrooms, changing rooms, and sleeping areas for male or female use. The rule uses biological sex, not gender identity, and covers overnight school activities on or off school property. Schools must offer a single-person facility to anyone who does not want to use the assigned facility. This option cannot allow opposite-sex access where people of the opposite sex are or could be present. Entry exceptions cover cleaning, maintenance, repairs, inspections, emergency medical help, caregiving, and disability- or age-related assistance. Someone receiving help may enter with a family member, guardian, or designee whose sex matches the facility's designation. Entry is also allowed to prevent serious health or safety threats during an ongoing disaster or emergency. Coaches may enter locker rooms for meetings only when no suitable meeting space exists and students are fully clothed. Adult-supervision requirements apply, and accompanying adults cannot be current high school students. School staff performing official duties must take steps to ensure no one is undressed. Temporary opposite-sex designations also allow entry. The law takes effect immediately upon becoming law.
Parents or legal guardians can sue a Wyoming public school if their student is enrolled and physically attends the district. Lawsuits can address violations of facility designations, required private alternatives, or entry exceptions. Parents can ask a court to declare the school's legal duties or order compliance. This lawsuit provision provides court orders, not money damages.
Wyoming school boards must adopt discipline policies for people who refuse to follow the school facility rules. The law does not set specific punishments. Boards cannot adopt policies that conflict with these rules.
