When H.R. 3684 is enacted, the law permanently cancels contract authority equal to the amounts provided here for each program. The Secretary must implement this by September 30, 2022 and may align it with successor programs. If H.R. 3684 had been enacted before this law, this law would not take effect.
The law keeps federal surface transportation programs running from October 1 to October 31, 2021. FY2022 funding equals 31/365 of each program’s FY2021 level, and obligation limits are also set at 31/365. The Secretary delays some State apportionments until after October 15, 2021. It protects Mass Transit Account apportionments from IRS/Treasury withholdings in FY2022. It extends spending authority for the Highway Trust Fund and related trust funds through November 1, 2021. These temporary rules end on October 31, 2021, or earlier if H.R. 3684 becomes law.
Federal employees furloughed because the Highway Trust Fund spending lapsed are paid for that time. Excepted employees who worked during the lapse are also paid. Pay equals your normal rate times the hours owed. Agencies must pay as soon as possible after the lapse, subject to available funds.
The law raises the cutoff for nationally significant freight and highway projects to $700,000,000 during the extension. It sets highway safety research funding at $31,872,000 for the same short period. These changes last through October 31, 2021 or end sooner if H.R. 3684 becomes law.
The law updates program-year dates so these programs do not lapse in October 2021. It moves certain Appalachian Regional Commission rules to 2022. It shifts a rail program date to October 31, 2021. It updates Sport Fish Restoration references to include fiscal year 2022. These changes end when H.R. 3684 becomes law.
