To amend title 38, United States Code, to establish a presumption that certain veterans were exposed to radiation and other toxins at the Nevada Test and Training Range for purposes of the treatment of certain disabilities under the laws administered by the Secretary of Veterans Affairs, and for other purposes.

In Committee
Summary
This bill would create a presumption that veterans were exposed to radiation and other toxins at the Nevada Test and Training Range from January 1, 1972 to January 1, 2005. That presumption would make it easier for affected veterans to qualify for disability benefits administered by the Department of Veterans Affairs.
Show full summary
- Veterans: Veterans who served onsite or in the airspace above covered NTTR locations during 1972–2005 would be presumed exposed to radiation and toxins, which could simplify VA disability claims for related conditions.
- Medical conditions: Lipomas and tumor-related conditions would be specifically presumed service-connected for eligible veterans from those NTTR locations, removing a barrier to establishing service connection for those diagnoses.
- Scope and locations: "Covered location at the Nevada Test and Training Range" includes NTTR sites such as Indian Springs Auxiliary Airfield and excludes Nellis Air Force Base and Creech Air Force Base. The presumption applies to onsite participation in development, construction, operation, or maintenance and to service while assigned to a duty station, including airspace above a covered location.

Easier VA claims for Nevada Test Range vets
If enacted, this would make it easier for some Nevada Test and Training Range (NTTR) veterans to get VA benefits. Service from Jan 1, 1972, to Jan 1, 2005 at a covered NTTR location, including airspace, would presume toxic exposure. Onsite work to build, run, or maintain a military installation there then would count as a radiation‑risk activity. Only for veterans under the toxic‑exposure rule, lipomas and tumor‑related conditions would be presumed service‑connected. Covered places include Indian Springs Auxiliary Airfield, but not Nellis Air Force Base or Creech Air Force Base. These changes would take effect upon enactment.
