Summary

Expands federal control over emissions for certain locomotives and small nonroad engines, explicitly blocking state emission standards. The LOCOMOTIVES Act would rewrite part of the Clean Air Act to broaden which locomotives and nonroad engines are governed by federal rules and to include locomotives engaged in common carrier railroad transportation under that federal definition.

Federal rules replace state limits for locomotives

If enacted, locomotives used in commerce would be under federal emission rules. That would include locomotives that provide common carrier rail service for pay under federal law. It clarifies the coverage applies to locomotives subject to the Clean Air Act. States would not be able to set separate standards. Rail operators could face added compliance duties and costs.

Federal rules replace state limits for small equipment

If enacted, EPA would set the emission rules for certain nonroad engines and vehicles. It would cover construction and farm equipment with engines under 175 horsepower that are regulated under the Clean Air Act. States would not be able to set their own emission standards for this covered equipment. Makers and operators could face new federal compliance steps and costs.
