Higher penalties for illegal entry
This bill would raise the civil fine for illegal entry from $50–$250 to $500–$1,000 per offense. Prosecutors could also seek higher criminal penalties if you have a prior visa‑overstay conviction, treating it like a repeat illegal‑entry case. Changes would apply at enactment.
New penalties for nonimmigrant visa overstays
If enacted, this would make being out of status for a total of 10 days a violation for nonimmigrant visa holders. A first violation could bring a fine, up to 6 months in jail, or both. Later violations, or a prior illegal‑entry conviction, could mean up to 2 years in jail. Each violation would also carry a civil fine of $500 to $1,000, doubled if you were previously fined under this overstay rule or the illegal‑entry civil penalty. These changes would take effect at enactment.
