  • Interstate motor carriers and insurers: Those defendants would face federal suits under this new jurisdictional grant when cases meet the bill’s criteria.
  • Plaintiffs and organizations in litigation: The bill fixes plaintiffs’ citizenship at the date of filing or, if needed, the date of service of an amended pleading or paper that shows federal jurisdiction. Federal court for big truck-crash cases

If enacted, some truck‑crash lawsuits could move to federal court. It would apply to crashes causing injury or death with a commercial truck on an interstate public road. The lawsuit would need to seek more than $5,000,000, not counting interest and costs, and involve parties from different states or a foreign party. Unincorporated groups would be treated as citizens of their main business state and their state of formation, and plaintiffs’ citizenship would be set at filing or when federal grounds first appear. This could give plaintiffs access to federal procedures while defendants may face more cases in federal court.
