Ending Forced Arbitration of Race Discrimination Act of 2025

Sponsored By: Representative Bell, Wesley [D-MO-1]

Introduced

Summary

Would ban predispute arbitration agreements and predispute joint-action waivers for disputes alleging race, color, or national origin discrimination. It would let the person alleging discrimination or a named class representative choose court proceedings instead of arbitration, and it makes courts, not arbitrators, decide whether the rule applies.

Show full summary
  • Workers and individuals alleging race discrimination could bring claims in court and elect class or collective actions instead of being forced into private arbitration.
  • Employers and businesses could no longer rely on pre-dispute arbitration clauses or joint-action waivers to block race discrimination suits under Federal, Tribal, State, or local law.
  • Courts would determine arbitrability for these disputes, moving initial challenges about arbitration from private arbitrators to judges.

Choose court over arbitration for race claims

If enacted, people alleging race discrimination could choose court instead of arbitration. Predispute arbitration clauses and class or collective action waivers would not be enforceable for these cases under federal, tribal, state, or local law. A court, not an arbitrator, would decide if this law applies, even if the contract says otherwise. Covered disputes would include discrimination, harassment, or retaliation based on race, color, or national origin. These rules would apply only to disputes that arise on or after the date the bill becomes law.
