The Stop Unfair Medicaid Recoveries Act would bar states from adjusting or recovering medical assistance that was correctly paid under a State plan and would force states to withdraw existing liens and notify affected people within 90 days of enactment.

Stops Medicaid recoveries and liens

If enacted, this bill would bar States from adjusting, initiating, maintaining, or collecting recoveries of Medicaid payments that were correctly paid on behalf of an individual on or after the date of enactment. States would have 90 days after enactment to withdraw any lien that is in effect on that date with respect to those correctly paid Medicaid payments. States would have to notify each affected individual, their legal representative, or their estate that the lien was withdrawn and that further recovery is prohibited. These rules would limit estate recovery and other post‑eligibility demands on Medicaid beneficiaries and their estates.
