In Committee

  • Exporters and applicants would get a clearer path for disputes over embargoed destinations because those cases would go through the interagency review and receive a required decision.
  • Federal agencies on the committee would be required to decide these cases by majority vote, and if they cannot reach a majority the committee's designated chair could issue the decision.
  • The bill defines "country subject to a comprehensive United States arms embargo" by cross-referencing table 1 of 22 C.F.R. §126.1(d)(1) as in effect the day before enactment and by explicitly including the Russian Federation.

New export dispute rules for exporters

This bill would expand the interagency export-control dispute process to include matters involving countries under a comprehensive U.S. arms embargo. It would define that term as the countries listed in table 1 of 22 C.F.R. §126.1(d)(1) as that section exists the day before enactment. It would also add the Russian Federation. Covered cases would have to be decided rather than left discretionary. If the Committee cannot reach a majority decision, the Committee chair would be authorized to decide the case. These changes would take effect upon enactment.
