New CFTC rules for proprietary data
This bill would require the Commodity Futures Trading Commission (CFTC) to make rules after notice-and-comment. The rules would extend Section 8 protections to proprietary information the CFTC gets that is not already covered. The rules would explain when the CFTC can request proprietary data and require safeguards based on how sensitive the data is. They would limit which staff can access the data and protect it from unlawful use or disclosure. The rules would also govern sharing with other government agencies and require assurances those agencies keep similar safeguards and follow confidentiality limits in subsection (e) paragraphs (2)-(4).
