  • States: Each state could require Medicare Advantage organizations that issue, sell, renew, or offer plans in the state to meet the program's requirements and could enforce those standards within their borders.
  • Medicare Advantage organizations: Plans would face state-level requirements where they operate and coordinated oversight with the Secretary, including possible collaborative enforcement agreements.
  • Markets and multistate oversight: The Secretary would coordinate enforcement with the state where an organization is licensed and with any state where it offers plans, enabling aligned enforcement across licensing and sales territories.

Medicare Advantage enrollees get stronger enforcement

If enacted, this bill would let each State require Medicare Advantage organizations to meet the part's standards for plans they issue, sell, renew, or offer in that State. The Secretary of Health and Human Services would have to coordinate enforcement with the State where an MA organization is licensed and with any State where the organization issues, sells, renews, or offers plans. The Secretary would also be able to enter into collaborative enforcement agreements with States. This would make enforcement more state-driven and help align federal and state actions to protect enrollees.
