  • People who monetize their name or likeness: For anyone making more than $1 million a year from commercial use of their name or image the naming ban would continue until they no longer meet that threshold. The $1 million amount would be adjusted annually for inflation using the Consumer Price Index for All Urban Consumers.
  • Federal agencies and inspectors general: An agency inspector general would investigate complaints alleging violations and report findings within 90 days to the agency head and to Congress.
  • Exceptions and informational uses: The rule would not apply to deceased individuals or to namings that occurred before the enactment date. Incidental uses of a person's name or likeness in museum exhibits, archival collections, educational materials, documentaries, official reports, press releases, or other informational materials would be allowed so long as the name is not the formal name or principal branding of a federal site or program.

No federal naming for 10 years

This bill would bar federal agencies from naming, renaming, or redesignating any federal building, facility, or program after an elected official or political appointee during a covered period. The covered period would start when the person first held office and end 10 years after they last left office. For people who earn more than $1,000,000 a year from commercial uses of their name, image, or likeness, the ban would continue until they earn less than that amount. The $1,000,000 threshold would be adjusted each year for inflation using the Consumer Price Index for All Urban Consumers.

Exceptions and enforcement for naming rules

This bill would create three exceptions to the naming ban. Agencies could keep names of people who are deceased and any name given before the bill takes effect. Agencies could also keep a name if the person was not using their name or likeness for commercial purposes at the time of the naming. The bill would allow incidental historical and educational uses of a person's name or image in museums, archives, school materials, government-funded documentaries, reports, and press releases so long as the name is not the formal title or main branding. Each agency inspector general would have to investigate complaints and report findings to the agency head and to Congress within 90 days of starting an investigation.
