HRES802119th Congress

Requiring the House of Representatives to convene and hold recorded quorum calls during a Government shutdown, and for other purposes.

Sponsored By: Representative Moskowitz, Jared [D-FL-23]

Introduced

Summary

Mandatory daily attendance and fines for House Members during a government shutdown. This bill would require the Speaker to bring the House into session every day a shutdown continues and limit multi-day adjournments until specific meeting rules are met.

Show full summary
  • House Members would have to record presence electronically on each day the chamber is in session during a shutdown. Missing two or more consecutive days can trigger fines of $500 for a first offense and $2,500 for subsequent offenses, with illness of the Member or a family member protected and an appeal right to the Ethics Committee.
  • House officers would run daily recorded quorum calls and must notify members and leadership in writing about fines. If a fine is unpaid after 90 calendar days the Chief Administrative Officer would deduct the amount from a Member's net salary, and implementing offices may set procedures for enforcement.
  • Delegates and the Resident Commissioner are covered as Members, and campaign or official funds may not be used to pay these fines.

Meeting rules and fines for Members

If adopted, the resolution would require the Speaker to convene the House every day a government shutdown is in effect. Each day the House met, there would be one or more recorded quorum calls and Members would record presence electronically. Adjournment or recess would be limited: it would be allowed only if the House met each of the first five days, any break was no more than two consecutive days, and the House then met for five straight days after that break. If a Member failed to record presence on two or more consecutive days, the Sergeant-at-Arms could fine $500 for a first offense and $2,500 for any later offense, unless the Member reported illness. A Member could appeal to the Committee on Ethics, and unpaid fines could be deducted from net salary after 90 calendar days; campaign and official funds could not be used to pay the fine. If adopted, the resolution would treat Delegates and the Resident Commissioner as Members for these rules.
