Summary

Compensates all poultry growers and laying facilities inside APHIS control areas, including non-infected operations in buffer zones. This bill would base payments on each owner's average income from their five most recent flocks multiplied by the number of flocks the owner was prohibited from growing or laying while the control area was in effect, reduce payments by any other compensation received for those same flocks, and require payment within 60 days after the owner files a claim.

Payments for poultry growers in control areas

If enacted, owners of poultry growing or laying facilities located inside an APHIS-designated Control Area would be able to request compensation. The payment would equal your facility's average income from its five most recent flocks multiplied by the number of flocks you were prohibited from growing or laying. Any money you already received from a State or other source for those same flocks would be subtracted so the federal payment does not exceed the difference. You would need to submit a request and the Secretary would have 60 days to pay after your request. Exceptions in subsection (d)(3) would apply, and no payment would be made if you already received compensation under subsection (d) for the same facility, Control Area, and period.
