Summary

Expands federal compensation to poultry facilities inside APHIS control areas, including non-infected operations in buffer zones. This bill would require APHIS to pay owners of poultry growing and laying facilities located in a control area based on the owner's average income from the five most recent flocks multiplied by the number of flocks the owner was prohibited from growing or laying.

One-time payments for poultry growers

If enacted, owners of poultry growing or laying facilities inside a Control Area set by APHIS would be able to request a one-time payment from the Secretary of Agriculture. The payment would equal the facility's average income from the last five flocks multiplied by the number of flocks the owner was barred from growing while the Control Area was in effect. The payment would be reduced by any money the owner already got from a State or other source for those same flocks. No payment would be made if the owner already received compensation under subsection (d) for destroyed animals for the same facility and time. The Secretary would have to pay within 60 days after an owner files a request. Exceptions in subsection (d)(3) would also apply.
