Medicaid, workers' comp, insurers get restitution

Beginning August 12, 2026, Medicaid, Medicare, and workers' comp can seek restitution for medical and related costs they paid for a victim. An insurer counts as a victim when it is defrauded or when its property is stolen or damaged. People who lose money because of certain contracts, including with an insurer, can also be treated as victims for restitution.

Restitution reduced when insurance pays

Beginning August 12, 2026, courts do not order restitution for losses a private insurance policy can pay. Courts can still order amounts insurance does not cover and the victim's deductible. In non-felony traffic cases, judges order only the uncompensated part and may award the deductible. Non-money harms like pain and suffering remain outside restitution.
