Patients get access to FDA-approved controlled medicines

Beginning August 12, 2026, Colorado does not treat an FDA-approved prescription product as state Schedule I when the DEA puts it on another schedule or exempts it. Colorado controls the product the same way federal rules do, and the change takes effect here on the same federal date. The product must be dispensed by a Colorado-registered pharmacy or given by a Colorado-licensed physician, and only people authorized by law may possess it. This change does not waive other Colorado drug-crime laws.

Natural medicine rules stay the same

This section does not change rules for natural medicine or natural medicine products. It also does not change actions under Article 170 of Title 12 or Article 50 of Title 44. Those programs keep their current rules starting August 12, 2026.

When this law takes effect

The law takes effect at 12:01 a.m. after the 90-day period following final adjournment of the legislature. That date is August 12, 2026 if adjournment is May 13, 2026. If a referendum petition is filed, the law takes effect only if voters approve it in November 2026. If approved, it starts when the governor declares the vote.
