Stronger consent for organ donation
Beginning August 12, 2026, no adult receiving services can have organs removed for transplant without their own consent if they are able to consent. If a doctor questions the person’s ability to consent, the state’s competency procedures apply. For people under 18, a parent or guardian may consent only after consulting the care team and an independent IDD professional not tied to the facility or home. Any person’s objection, at any age, stops donation.
Stronger consent for sterilization of people with disabilities
Beginning August 12, 2026, sterilization of an adult with an intellectual or developmental disability requires informed consent. If the person has decision-making capacity, they cannot be sterilized against their will. If the person lacks capacity, sterilization is only allowed to prevent an imminent threat to life or health and must follow state law or a court order. Two independent professionals must evaluate capacity and consult with the operating doctor. Counseling on long-term impacts and less intrusive options is required before any decision. Minors need a court order. Consent is final after the procedure, and providers relying on it are not liable.
Old sterilization procedures repealed in 2026
Beginning August 12, 2026, Colorado repeals sections 25.5-10-232, 25.5-10-233, and 25.5-10-234. These sections covered competency and court-ordered sterilization procedures. Courts and providers follow other state laws or court processes instead. This change may alter how competency and consent are decided.
