Carrier duties when dentists consent

When a dentist consents, carriers must follow transparency and notice rules. Carriers must let the dentist choose to contract directly with the third party. Any lease must follow the provider’s contract terms and fee schedules. Carriers must list all third parties in writing and online, and update the list at least every 90 days. Carriers must give the dentist at least 30 days’ notice before a new lease starts. They must tell each listed third party at least 30 days before the carrier‑provider contract ends. Every remittance must show who applied the discount, and carriers must send the contract used to pay a claim within 30 days on request. Third‑party access ends when the carrier‑provider contract ends, subject to continuity‑of‑care rules. Notices can be sent in writing or electronically. These rules apply to agreements entered or renewed on or after August 12, 2026. If a referendum petition is filed, they take effect only if voters approve them in November 2026.

Dentists must consent to leased access

Carriers must get a dentist’s affirmative consent before letting any third party use that dentist’s discounts or services. “Affirmative consent” means a clear yes with a signature; electronic signatures count. A carrier cannot drop or refuse to contract with a dentist just for saying no to third‑party access. These rules apply to agreements entered or renewed on or after August 12, 2026. If a referendum petition is filed, they take effect only if voters approve them in November 2026.

Exemptions for Medicaid and same-brand networks

These rules do not apply to dental networks serving Medicaid or CHIP patients. They also do not apply to access within the same brand licensee program if the carrier posts the list online. These exemptions apply to agreements entered or renewed on or after August 12, 2026. If a referendum petition is filed, they take effect only if voters approve them in November 2026.
