Quick HOA record handoff with fines
When an HOA ends or does not renew a management contract, the old company must deliver all property and records within 45 days at no charge. The company does not have to hand over proprietary software, but it must give the association its data and records from that software. After the 45-day deadline, it owes $250 for each business day it is late and is liable for interest, late fees, and other damages. If a court finds the violation willful, it must pay three times the association’s actual damages, plus attorney fees and court costs.
Developers must fund 30-year reserve study
The law requires the developer to pay for a reserve study before control shifts to the association. A qualified, independent professional must do the study. It must estimate repair and replacement costs for 30 years. Within 60 days after owners elect a majority of the board, the developer must deliver the study to the association. Within 90 days after control and within 90 days after each fiscal year, the association must make the latest study available to owners on reasonable notice.
