Clearer rules for prepaid phone purchases

The law clarifies what counts as prepaid wireless service: it is paid in advance, sold in set units or fixed periods, and allows 911 calls. A purchase can be made with money or with required customer information used for federal reimbursements. A retail transaction is a sale to an end user, not a resale. Prepaid wireless service follows the prepaid disability access charge rules, while other telecom services use different sections. The code now uses the same meanings for prepaid wireless and telecommunications service across related laws.

Online filing for prepaid 988 reports

The revenue department can require businesses that report or pay the prepaid 988 charge to file returns online and pay by electronic funds transfer. Some legal exceptions apply. This makes reporting and payment for the 988 fee an electronic process.

988 fee on prepaid phone purchases

Beginning January 1, 2022, each prepaid phone purchase in Colorado includes a 988 charge. The crisis hotline enterprise sets the amount each year by October 1 for the next year, and it cannot be more than $0.30 per purchase. Sellers must collect the charge on every retail transaction and send it in. They must choose how to show it on receipts (separate line or combined with the 911 fee) and need written state approval to change that. A seller is treated as having collected it even if it is not shown as a separate line. Lifeline-supported prepaid service does not pay this charge. These collection rules apply to prepaid wireless service; other telecom services use different sections.

Stronger privacy for telecom fee records

The revenue department must share prepaid disability access charge filings with the utilities commission and the disability services enterprise. The shared information stays confidential, and employees face penalties for misuse. The law also applies general tax administration rules to prepaid phone and wireless fees when not in conflict. This creates more consistent and protected oversight of these telecom fees.
