PERA retirement option for facility school staff

Beginning August 12, 2026, approved facility schools can apply to join the Public Employees' Retirement Association (PERA). The PERA board must approve the application. If your school affiliates, you become a PERA member and employer and member duties start on the affiliation date. Any affiliating approved facility school is placed in PERA's local government division. A referendum, if filed, can delay or stop this law until voters decide.

Facility schools need 65% to leave PERA

Beginning August 12, 2026, an approved facility school in the local government division can vote to leave PERA. Its governing board must pass an ordinance or resolution, and at least 65% of employee members must approve. Employees must get a written notice about the rules before the vote. If the employer stops operating or stops participating, it is treated as having ended PERA affiliation and must follow required wind-down steps. A referendum, if filed, can delay or stop this law until voters decide.
