Emergency spending to keep services running

The law lets the state controller approve emergency spending above an agency’s current-year line item when the legislature is not meeting. This applies when unexpected events arise or when a federal funding lapse is likely, as determined by the Joint Budget Committee. If overspending happens, the Joint Budget Committee must introduce a supplemental appropriation for that same fiscal year, up to the overspend. Once a supplemental is enacted, only that amount releases the hold on next year’s appropriation, and the agency cannot exceed its next‑year line item. The extra‑spending authority ends when the supplemental is enacted.
