Broader community-property rules for Colorado real estate

Beginning August 12, 2026, more Colorado real estate falls under community property rules at death. It covers property in Colorado that was bought with community funds or is traceable to community property under the law of the state where the decedent or surviving spouse lived when it was acquired, or when it later became community property. This applies even if the person who died did not live in Colorado. Rent, income, profits, and increases in value from that Colorado property are also covered. These rules can strengthen a surviving spouse’s share and estate rights.

When Colorado community-property changes start

The law takes effect at 12:01 a.m. the day after the 90‑day period following the legislature’s adjournment (example: August 12, 2026, if adjournment is May 13, 2026). If a referendum petition is filed in that window, the law or the parts challenged do not start unless voters approve them at the November 2026 election. If approved, those parts start on the date the governor officially declares the results.
