Faster warrant response from big platforms

Beginning on the law’s effective date (expected August 12, 2026, unless a referendum delays it), big online platforms must offer a 24/7 contact path for Colorado police. Each platform keeps a staffed hotline, posts contact info on its home page, and acknowledges any search warrant within 8 hours. Operators must give status updates and comply with a court-ordered warrant within 72 hours when it is from Colorado law enforcement, seeks a Colorado user’s account information, and the data is controlled by the user or the operator. A court can extend the 72-hour deadline for good cause. Compliance must also follow the Colorado Constitution, the Colorado Privacy Act, and other listed state protections. The Attorney General or a district attorney can sue for injunctions, restitution, disgorgement, damages, and civil penalties up to $5,000 per violation. Not complying with a court-ordered warrant can lead to contempt of court. These rules apply to warrants provided on or after the effective date.

Which online platforms are covered

The law covers public or semi‑public websites, services, or apps with at least 1,000,000 monthly users that let people make profiles and post content others can see, including AI‑generated content. It excludes internal company tools limited to employees or affiliates, and services that mainly provide non‑user‑generated news, sports, entertainment, or e‑commerce content (or only have limited comments tied to that content). An “operator” is the person or company that runs the platform. A “user” is a Colorado resident using the platform, not acting for the operator. A “search warrant” includes a court order for production of records.
