Voter petitions trigger firefighter bargaining vote
When a petition has signatures equal to at least 5% of voters from the last regular municipal election or the last general district election, the employer must place a yes/no question on the next general election ballot. For a fire authority, the 5% is based on the total votes of each party’s general election. The question asks whether firefighters employed by the public employer should be covered by the Colorado Firefighter Safety Act. A majority “yes” means the employer must bargain, and the named employee group becomes the exclusive representative. A majority “no” keeps the meet-and-confer process and no duty to bargain. “General election” now includes regular municipal and special district board elections, statewide primary and general elections, and coordinated elections. Local charters or ordinances may set different petition rules.
Law begins August 12, 2026, pending referendum
The law takes effect at 12:01 a.m. the day after the 90-day period following the legislature’s final adjournment. If adjournment is May 13, 2026, that date is August 12, 2026. If a referendum petition is filed within those 90 days, the law (or parts of it) does not take effect unless voters approve it at the November 2026 election. If voters approve, it takes effect on the governor’s official declaration of the vote.
