Contractors face penalties for inflated public bond claims
Beginning August 12, 2026, filing an excessive claim on a Colorado public construction bond carries penalties. If you claim more than is due, have no reasonable basis that it is owed, and know it is too high, the claim can be ruled excessive in an Article 26 proceeding. You then lose all rights under that law to recover the claimed amount. You must also pay all costs and the other side’s reasonable attorney fees spent bonding over, contesting, or responding to your claim.
