State agencies keep privilege with Auditor

Beginning August 12, 2026, sharing materials with the State Auditor or the fraud hotline committee does not waive legal privileges. Sharing with the Governor also does not waive them when the committee has approved sending the investigation results. Protected claims include attorney-client, attorney work product, common-interest, deliberative-process, and other confidentiality or public-records exemptions. The law also defines “information or materials” to include agency writings and verbal answers to the Auditor about the investigation. If a referendum petition is filed, these rules take effect only if voters approve them in November 2026 and officials declare the result.
