The fire marshal must give written notice of violations or required fixes at covered early learning and child day care centers. The notice must cite the specific code rule. An affected person can appeal to the Division of Administrative Law within 15 days after receiving the notice. All enforcement actions, including fines, penalties, and closures, are paused until the appeal is finally decided. The marshal must prove that the requirement is expressly authorized by adopted state or federal fire and life safety codes.
Louisiana’s state fire marshal still oversees covered early learning and child day care centers, even where local fire bureaus exist. The marshal can enforce only requirements expressly stated in adopted state or federal fire and life safety codes—not add rules through policy, guidance, or interpretation. Requirements must fit each center’s size, occupancy, and risk; commercial or industrial standards apply only when the code expressly requires them. Standard home appliances, such as microwaves and coffee makers, do not require commercial ventilation or fire suppression unless expressly required by code. Local fire departments keep their right to consult with the marshal and plan for fires at facilities in their jurisdiction.
