Higher school-zone drug penalties, with an exception

Louisiana extends school-zone penalties to people convicted of drug offenses while smoking, vaping, or otherwise abusing controlled drugs. This covers school property, areas within 2,000 feet, and school buses. The general penalty allows the maximum underlying fine and prison time up to 1.5 times the underlying offense’s longest term. Parole, probation, and suspended sentences are barred to the same extent as the underlying felony’s minimum sentence. An exception replaces these rules for school-zone violations also covered by R.S. 40:966(C)(2): up to one year in prison, with or without hard labor, and a fine up to $1,000.
