2 provisions identified: 0 benefits, 1 costs, 1 mixed.

Covered employers must get background checks

Employers covered by this Louisiana law must obtain criminal history and security checks. Checks must follow R.S. 15:587(B) and (F), R.S. 40:1203.2, or other applicable law. The law states no check cost or household payment. Its criminal-record rules are intended to ensure compliance with state and federal requirements, including federal criminal-record regulations and FBI security policy.

New privacy limits for workers' records

Covered employees' criminal records can be shared only by court order or written consent directing the appropriate law enforcement agency to release them. Employers cannot send copies of criminal checks to other employers seeking referrals of potential applicants. The law also removes this section's requirement to destroy records within one year. It does not authorize further sharing of criminal history information obtained from the FBI. State criminal history information must be kept and shared according to state law.
