Providers avoid liability for others’ content

Covered service providers and broadcasters are not liable under the campaign-call law for content supplied by someone else. This covers interactive computer services and internet, cloud, cybersecurity, information, and telecommunications providers. It also covers radio and television broadcasters, including cable and satellite programmers, operators, and producers. The protection applies only to liability under this section for another person’s content.

AI campaign calls require clear warnings

Anyone making or arranging a covered campaign call must clearly disclose at the start that artificial intelligence created it. This applies when the call uses a public figure’s voice, including elected officials or people prominent in a public controversy. Public figures also include famous people, people shaping public issues, and prominent speakers paid per event. Covered automated calls include calling campaigns that use prerecorded or artificial voices to deliver information. Violations carry civil fines up to $2,500 for the first violation and $5,000 for each later violation. Louisiana’s Board of Ethics enforces these rules, and the law also expands its authority to enforce other state laws.
