Bill Overview

Analyzed Economic Effects

3 provisions identified: 1 benefits, 1 costs, 1 mixed.

Local governments gain group buying options

Louisiana local governments can buy materials, equipment, supplies, services, and related installation directly from or through qualified purchasing groups. They can make agreements with one or more groups. For-profit or nonprofit groups qualify with at least two local governments that participate or vote as members and seek vendor bids or proposals. The law also recognizes outside purchasing activities defined by state procurement law. Listed prices must stay in effect for at least three months. Purchases must cost less than the state contract or bid-list price for the same or substantially similar items. Purchases also qualify when those items are not on either state list. Buying from other vendors still requires the usual state purchasing process.

Public access to purchasing prices narrows

A qualified purchasing group's submitted price list is not a public record and is closed to public inspection. The agreement establishing the list and its effective date remain public records. Prices for items being bought become public when bids open or the purchase contract is signed.

Governments can skip single-source bidding

Louisiana public buyers can award contracts without competing bids when only one source exists for a required supply, service, or major repair. The chief procurement officer or a designee above the procurement-officer level must make that finding in writing. Applicable regulations must authorize the decision.
