Private airport owners get emergency-landing liability protection

Louisiana law limits private airport owners’ legal responsibility for loss or damage to people on their property during aircraft emergency landings. This protects qualifying owners but limits injured people’s ability to recover payment from them. The airport must mainly serve its owner, with others allowed to use it without an admission fee. Donations and contributions to cover costs do not count as admission fees. Protection excludes harm caused by a willful or malicious failure to warn about a dangerous condition, use, structure, or activity. Commercial recreation sites are excluded, whether they charge for access or not. Covered owners include tenants, occupants, and others controlling the property, not just landowners. For recreational leases to government or private parties, protection applies unless the parties agree otherwise in writing. Land users must still use reasonable care and face legal consequences for failing to do so.
