No bail on appeal for serious felonies

Beginning November 1, 2025, people convicted of certain serious crimes cannot get bail while they appeal. The list includes murder, kidnapping for extortion, robbery with a dangerous weapon, rape, first-degree arson, shooting with intent to kill, first-degree manslaughter, and forcible sodomy. It also includes any felony that used or involved a gun or other deadly weapon, drug trafficking, making controlled drugs, abuse against an intimate partner (as defined in state law), child abuse, sexual abuse of a child, and any felony after a prior felony conviction.

Bail on appeal in minor cases

Beginning November 1, 2025, a person convicted of a misdemeanor can ask for bail while appealing. A person convicted of a felony with a fine-only sentence can also seek bail on appeal. If bail is set and approved, the judgment is put on hold during the appeal. For other felonies not on the banned list, the trial judge may grant or deny bail. If the judge grants bail in those cases, the judge must say on the record why.
