If you are convicted of violating the ban, you face a misdemeanor. You can get up to 1 year in county jail. You can be fined between $500 and $1,000. The court can impose both jail and a fine.
The law declares an emergency and takes effect right away. The ban and other rules apply from the date of passage and approval.
You cannot put on an adult performance with obscene material in a public place when minors can see it. Local governments cannot allow or organize such shows on public property. A minor is an unmarried person under 18. A public place is an area the general public can enter for free; places that require admission or keep out minors are not public places under this law. Obscene material uses the meaning set in another state law.
This state law overrides local rules that conflict with it. A city or county cannot rely on an older ordinance or license that conflicts with this section. If a local government follows the law in good faith, it is not liable for someone else’s violation. This protects cities and counties that act in line with the statute.
