Sharing private or AI sexual images is illegal

The law makes it a crime to share someone’s sexual image taken in a private setting without their consent. It also bans sharing AI‑made sexual images of a person without consent when it is done to harass or harm. The law does not apply to lawful criminal investigations, reporting illegal conduct, voluntary public or commercial exposure, or other lawful purposes.

Tougher penalties for nonconsensual image sharing

A basic violation is a misdemeanor: up to 1 year in county jail, a fine up to $1,000, or both. If the person gains or tries to gain money or property, it is a felony with up to 5 years in prison. A second such felony can mean up to 10 years and sex offender registration. Sharing three or more images in six months is also a felony with up to 10 years. Prosecutors cannot file a misdemeanor instead of the felony in gain‑of‑value cases. Courts can order the defendant to remove the images if they can do so, and property can be forfeited after conviction.

Online providers keep immunity for posts

The law does not make internet, wireless, or telecom companies liable just because someone else posted the content. It keeps providers’ immunity for third‑party posts under this section.

When these rules start

All parts of this law take effect November 1, 2025, unless a section gives a different date.
