If a high school student is also enrolled in a college class, sex or sexual touching by an employee of that college is a crime under the rape or sexual-battery laws. A college employee includes faculty, adjuncts, instructors, volunteers, and contractor employees who can exercise school authority. A student worker or volunteer is not treated as an employee for this rule if they are enrolled and not more than three years older than the high school student.
Sex between a school-system employee age 18 or older and a student who is at least 16 and under 20, and is in school or under school supervision, is rape. Intentional sexual touching in that same employee–student relationship is felony sexual battery. School resource officers and security guards count as school employees, including when hired through a private contractor. These rules apply to public or private elementary or secondary schools, junior highs, high schools, and technology center or vocational schools.
The law declares an emergency. It takes effect upon passage and the Governor’s approval. The new criminal protections apply right away.
