Owners get fee reimbursement in eminent domain

Beginning November 1, 2025, the law lets property owners recover reasonable, actually incurred attorney, appraisal, engineering, and expert-witness fees in more condemnation outcomes. You qualify if the case is abandoned or a final judgment says the property cannot be taken. You also qualify when the owner (or both sides) asks for a jury and the jury award is at least 10% higher than the greater of the commissioners’ award or the last timely written offer. If only the condemning authority asks for a jury, you qualify when the jury award is at least 90% of that greater number. A written offer is timely if made within 75 days after the commissioners’ report is filed, and the condemning party pays the awarded sums.
