Clear dementia care details before placement

Beginning November 1, 2025, any facility that advertises memory or dementia care must give a state disclosure form. The form explains care approach, staff ratios and training, activities, safety features, fees, and accreditations. Facilities must give the form to the Health Department, the Long-Term Care Ombudsman, and to you or your representative when you consider placement. They must file it before signing any care agreement and report updates when details change.

Dementia patients can use non-special facilities

Beginning November 1, 2025, facilities without a special memory-care unit can still admit people with dementia. This keeps more placement options open for families.

Easy public access to memory care info

Beginning November 1, 2025, after you tell a referral agency that a person has dementia and you seek placement, the agency must give you electronic or paper access to each facility’s disclosure form. This duty does not apply if no form is on file with the Health Department. The Health Department keeps a public, searchable website with the forms and key items like staffing, training, programs, and accreditations. Facilities with special memory-care units must post the form on their website and a clear poster in the unit. The poster says you can complain to the Attorney General if you did not get the form.

Stronger checks and penalties for memory care

Beginning November 1, 2025, the Health Department checks each disclosure for completeness and accuracy and verifies services during inspections. If a facility or its staff break this law or its rules, the Department can use license enforcement actions. The Health Commissioner writes rules with help from a new nine-member advisory council of experts and family representatives. Members serve without pay, and consumer members cannot work for regulated facilities.
